Terms of Service

Kafkana ("the Service") is an AI companion service operated by Appligon Co., Ltd. ("the Company", "we", "us"). The Service provides features including text chat, AI image generation, and AI video generation.

By using the Service, you agree to be bound by these Terms of Service.

This Service is strictly for users aged 18 and above. Access and use by anyone under the age of 18 is strictly prohibited.

Age verification is performed during account creation. Providing false age information will result in immediate account suspension.

All text, images, videos, and audio generated by the Service are fictional content produced by artificial intelligence (AI).

Generated content bears no relation to any real persons, organizations, or events. We make no guarantees regarding the accuracy, completeness, or appropriateness of AI output.

You acknowledge that AI-generated content is fictional and agree not to confuse it with reality.

2257 Exemption Statement (US): All content generated by the Service is produced entirely by artificial intelligence and does not contain any photographic or recorded depictions of real persons. Accordingly, the Service is exempt from the record-keeping requirements of Title 18, United States Code, Section 2257 (18 U.S.C. §2257) and 28 C.F.R. Part 75. All content is AI-generated; no performers are depicted.

Consent Statement: All acts depicted in content generated by the Service are presented as consensual interactions between fictional adult characters created by AI. The Service is not intended to depict sexual acts involving any real persons, nor any non-consensual activity.

Users must not engage in any of the following. Upon detection of a violation, we will immediately suspend the account, remove the generated content, and report to law enforcement authorities where necessary.

Strictly Prohibited Sexual Content:

• Generating or requesting content depicting, suggesting, or implying minors (anyone under 18 years of age) — child sexual abuse material (CSAM), including infantilization, "diaper", or other age-regression scenarios
• Deepfakes: generating, requesting, or synthesizing images, video, or audio that use or replicate the appearance or likeness of a real or identifiable person (prohibited regardless of whether that person has consented)
• Generating or requesting sexually explicit content involving real or identifiable persons (including celebrities, acquaintances, public figures, etc.)
• Non-consensual sexual acts, rape, or sexual assault (non-consent), including scenarios involving sleeping or unconscious subjects
• Sexual activity while incapacitated or under the influence of drugs, alcohol, or hypnosis
• Incest — sexual activity between blood relatives. Note: using non-blood step-family relationships (e.g. step-sister, step-brother) as a character setting does not fall under this prohibition.
• Bestiality, zoophilia, or animal cruelty
• Necrophilia
• Sexual content involving violence, abduction/confinement, or snuff / fantasy snuff (depictions of killing, whether real or fictional)
• Watersports, scat, or other extreme bodily-fluids content (coprophilia)
• Prostitution or escorting content/scenarios
• Content promoting or encouraging bigamy (being legally married to more than one person at the same time). Note: group conversations with multiple characters do not fall under this prohibition.

Other Prohibited Activities:

• Generating or distributing illegal content, or facilitating illegal activity (e.g., how to build a bomb, or any illegal plotting)
• Generating or requesting content that glorifies or promotes real-world violence, abuse, terrorism, or self-harm / suicide
• Hate speech, or content that promotes discrimination or hatred based on race, ethnicity, religion, gender, sexual orientation, disability, or similar characteristics
• Presenting professional advice (including, but not limited to, medical, legal, financial/investment, or gambling/handicapping advice) as fact — character responses are fictional entertainment and are not professional advice
• Generating or distributing content that infringes copyright, trademark, or other intellectual property rights
• Reverse-engineering or gaining unauthorized access to the Service
• Harassing or disturbing other users
• Using generated content commercially without our written permission
• Using automated tools to excessively access the Service

Reporting Abuse: If you encounter content or users that violate these prohibitions, please report to info@appligon.com with the subject line "[REPORT]".

Copyright in characters you create on the Service (including their name, settings, and generated images) remains with you.

If you set a character to "public" and we approve it, that character appears on the home screen and other users can chat with it.

For published characters, you grant us a free, non-exclusive license to use the character's name, image, and description (including reproduction, public transmission, and adaptation) for the purpose of featuring or promoting it on the Service and on our official social media accounts.

We never disclose the creator's account name, email address, or any other personal information when featuring a character.

If you set a character back to private, we will stop featuring it. For posts already published, contact info@appligon.com and we will remove them within reason.

The Service uses "Appligon Points" for features such as image and video generation. Points can be purchased through designated payment methods.

Subscription plans renew automatically. You are charged when you first subscribe, and then automatically on each renewal date for the term you chose (1, 3, or 12 months), until you cancel.

While your subscription is active, points are granted to your account every month (the amount depends on the plan and is shown before purchase).

Your credit card statement will show "OVERSEAS PURCHASE". This is because payments are routed through our payment provider's network; neither the Kafkana service name nor our company name appears on the statement.

You can cancel your subscription at any time from your account settings page.

After cancellation you keep access to the Service until the end of the current billing period. Cancelling mid-term does not entitle you to a prorated or partial refund.

Due to the nature of digital content, all purchases are non-refundable. This applies to subscriptions, point purchases, and any content purchased with points.

The only exception: if we were unable to deliver the Service due to a technical failure on our side, we will address it individually. Please contact our support team.

We reserve the right to suspend or delete any account that violates these Terms without prior notice.

You can delete your account yourself at any time from your account settings page. Deletion erases your chat history, generated images and videos, characters, and profile information.

Transaction records relating to purchases and cancellations are retained, with the link to your name and email address removed, because retention is required by law (see Section 8 of our Privacy Policy).

If you have an auto-renewing paid plan, you must cancel it before deleting your account (this prevents billing continuing after the account is gone).

These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising between the Company and users in connection with the Service shall be subject to the exclusive jurisdiction of the Shizuoka District Court as the court of first instance.
